Policies & Terms

 

This is not the-so-fun stuff about your booking, but essential for you to know to ensure you have the best possible experience.

 

Payment Details

A non-refundable payment of 50% is required to secure a date. All food and beverage purchases to be paid in full upon booking. An additional security deposit is required as damage security to all picnic rentals. Amount of security deposit varies depending on value of rentals included with Customer's picnic, ranging from $50 - $200. If no damages are found, this security deposit will be returned via Customer's payment method on file within 1 business day from your picnic. Processing to Customer's bank may take 3 to 10 days to return to you. Final payment is due 72 hours prior to scheduled picnic date.

Payment details can be found on the invoice sent to customer via email. The event set up will not occur without full payment prior. 

If payment in full is not paid three days before the event- the event will be cancelled and no refund will be given.

ID Requirements

Proof or License matching the booking form will be required upon picnic setup in any public location. 

Cancellation & Refunds

Due to our high number of bookings, deposits are non-refundable as we have held your date and turned down other events to do so. Any food or outside vendor fees that Brie & Baskets has paid for up front will also be non-refundable if customer chooses to cancel or reschedule. Refunds are not available for services provided but not utilized by the customers. Please book carefully as we do not provide refunds due to change of mind or wrong decisions. Our luxury picnics are like small events - do you reschedule your wedding or birthday bash once you book a venue? The same goes for our picnics. We will try our best to accommodate a reschedule, but due to our busy schedule, a new mutual date is not guaranteed. Our food partners are caterers are require orders in advance, it's not the same as ordered at a restaurant. Again, if you book a caterer for your wedding do they accommodate reschedules easily? No, and unfortunately neither can we. 
Emergency cancellations must be made 48 hours prior to event or full cost of picnic will be forfeit.

Rescheduling of picnic due to change of mind or Customer availability will only be considered once (considered, not guaranteed), and again, customer will incur the amount of any food items or outside vendors already purchased. Second cancellation forfeits full amount of picnic cost. Rescheduling due to weather will only be considered if extreme weather conditions are forecasted.

Wet Weather

Sunshine is not always guaranteed, and living in Pittsburgh means the weather is constantly changing hour by hour, so in the interest of your special day still being absolutely fantastic we do require the customer to choose a back up plan where we can continue the event as planned. Rescheduling is the absolute last resort that we do not recommend due to busy schedules and difficulty finding a new date.

 

The following are options preferred by Brie & Baskets:

  1. Terrene in Station Square: $150 venue rental fee. No outside food or beverage allowed. Customer may purchase any of the Ambient Boxes and Ambient Meals from Kimberley Ashlee Catering. Any Modern Charcuterie orders will be converted to charcuterie from Kimberley Ashlee Catering. Additional fees may apply.

  2. Pavilion at Public Park. Must be rented by Customer and proof of rental must be sent to Brie & Baskets.

  3. Bubble Tent. $50 picnic insurance fee to have bubble tent protection. 

  4. Indoors Private Residence.
     

In the event of bad weather, The Customer agrees that Brie & Baskets can request a location change and/or time change due to predicted weather and for security of the property and safety of staff, may refuse set up should an alternative location not be sought. It is the responsibility of the customer to source an alternative location. Bookings which are paid in full that require cancellation due to severe weather, where practicable, will be re-scheduled within a 3- month period. Additional costs for all the perishable items or outside vendors e.g. flowers, food, balloons etc. will be incurred if cancelled or rescheduled less than 72 hours prior to the event. Rescheduled dates are subject to availability. 


The company reserves the right to cancel the booking on reasonable grounds within any period leading up to the event. In the event this occurs, the customer will be refunded in full with the exception of where the customer has failed to fulfill their obligations within these terms & conditions

Use of Equipment

All Equipment supplied on hire is the property of the Company.

Any damage, loss or extensive cleaning will result in a fee to The Customer.

The persons hosting the event shall be responsible for any loss or damage to any items such as platters, ceramic bowls/plates, vases, props, small & large décor, and other decorations. Fees will apply for replacement at the full cost of purchasing a replacement. These fees are payable within seven days of such loss or damage unless agreed otherwise.

The Customer shall pay for all equipment damage or loss however caused during that period. Damage includes but is not limited to;

  • Improper use of equipment

  • Disappearance of the equipment

  • Damage to, or loss of, the equipment from any unknown cause

  • Cigarette burns on any furniture or décor items. Smoking is not permitted on or near the property of Brie & Baskets. 

  • Red wine or other staining product spillages or stains on any furniture or décor items

With the exception of battery powered candles and bug repellant candles, no fires or other flammable properties are to be lit during the booking.​ A security deposit of $50 is required to protect any damages to equipment. Larger rentals may require a $200 security deposit. Barring no damages are found this security deposit will be returned within 3 days of your picnic date via the same payment method in which all payments were made by the Customer.

In the event of the Equipment being stolen from the booking site, the Customer shall notify the Company in writing stating the full circumstances of the theft and the time the police were notified.

The Customer shall also indemnify the Company for any such loss of the Equipment at the current replacement cost of the Equipment, and must pay that cost to the Company on demand.

 

All hired equipment must not be relocated from the designated place of set up by the company.

 

The Customer warrants that all equipment will not be left unattended for the duration of the booking.

The Company shall not be liable for any loss or damages arising out of the overloading, exceeding rated capacity, misuse, or abuse of the Equipment by the Customer and the Customer agrees to keep the Company indemnified in respect thereof.

 

In order to retake possession of the equipment, it shall be lawful for the Company to enter into or upon any premises where the same may be and the Customer hereby agrees to indemnify and to keep indemnified the Company against all liability and against all actions, suits, proceedings, claims, demands, costs and expenses howsoever incurred by the Company arising from the Company's entry into or upon any premises in exercise of its rights of repossession.

 

Any person agreeing to a booking and it’s terms and conditions on behalf of the Customer hereby agrees that he or she has the authority of the Customer to make this agreement on the Customer’s behalf and has the Customer’s permission to bind the Customer’s to this agreement and hereby compensate the Company against all losses and cost incurred by the Company arising out of the person signing this agreement failing to have such power and/or authority.

 

The Customer shall be responsible for giving any local or other authorities any necessary notice of their intention to occupy an area within the authority’s locality and shall pay all fees in connection therewith. In the event that the Company incurs or suffers any loss, costs or damages as a consequence of the Customer's failure to carry out its obligations under these terms the Customer shall be solely responsible and shall indemnify the Company for any such loss, costs or damages.

Food, Beverage, & Public Parks

All of our basic packages come equipped with water and an ice bucket filled with ice. If you do not wish to purchase a food through Brie & Baskets, you are welcome to bring your own food & beverages. Please note: Pittsburgh Public Parks do not allow the use of glass. You will find that our public picnics will all have plastic cutlery, plates, and glassware. Pittsburgh Public Parks also do not allow the use of public alcohol consumption. Brie & Baskets is not liable if you choose to bring your own alcoholic beverages. If choosing to host your picnic in a public park, we cannot guarantee for set-up to occur in any given specific location within that public park. Brie & Baskets cannot control nor is liable for other persons utilizing the public park at the same time as your scheduled picnic. 

Site Management

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site. The Customer is not required to leave the event site unattended. The Customer agrees to waiting for a team member of Brie & Baskets to return to site at the end of the agreed booking time before leaving. If Customer wishes to leave the event site before the agreed booking time is complete, Customer is to notify Brie & Baskets, wait for a team member to arrive before leaving, and agrees that no refunds will be offered for leaving a booking early. 

Hire Obligations

Unless otherwise agreed by the Customer and the Company, all sitting times are for a 2 hour period.

Extension to the sitting time will not occur in the event the customer does not arrive on time. The commencement and conclusion time of a booking will remain as per the original agreed booking.

To avoid impact on successive bookings, in the event a Customer is greater than 15 minutes late to a booking, forfeiture of the booking will occur.

 

Extended Hire

The Customer agrees that the booking is for the agreed duration as confirmed at the time full payment for the booking occurs.

 

A request to extend booking duration must occur 3 days prior to the booking date and is subject to availability. No refunds will be issued in the event the extended hire is not fully utilized. 

Extended hire is charged at a rate of $50 per hour if scheduled in advance and $75 per hour day of time extensions. 

Advertising

Brie & Baskets has the right to all photos taken at the booking for social media and advertising purposes.
